Terms of Service

This is a plain-language summary of the terms that govern your use of EveryDay CRM. It is a general template and is not a substitute for legal advice — we recommend having it reviewed by a qualified attorney before relying on it for your business.

Note:"EveryDay CRM" is currently operated as a sole proprietorship, not a registered LLC or corporation. Once an LLC is formed for EveryDay, update this document to name that entity instead.

1. Acceptance of Terms

These Terms of Service ("Terms") form a legal agreement between you ("you," "your," or the "Customer") and EveryDay CRM ("EveryDay," "we," "us," or "our") governing your access to and use of the EveryDay CRM software, website, and related services (collectively, the "Service").

By creating an account, starting a free trial, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Who Can Use EveryDay

You must be at least 18 years old and have the legal authority to bind the business you represent to use the Service. By registering, you represent that the information you provide is accurate and that you are authorized to act on behalf of your business.

3. The Service

EveryDay is a customer relationship management (CRM) platform built for home service businesses and contractors, offering tools such as customer management, job scheduling, estimates, invoicing, a sales pipeline, crew management, calendar, and reporting, depending on your subscription plan.

We may add, change, or remove features at any time. We'll do our best to give you notice of changes that materially reduce the functionality of a plan you're paying for.

4. Free Trial

New accounts receive a 14-day free trial with full access to the Service, regardless of the plan selected at signup. No credit card is required to start a trial. At the end of the trial period, you will need to subscribe to a paid plan to continue using the Service — your account and data are not deleted, but access is paused until you subscribe or we reactivate your account.

5. Subscriptions, Billing & Cancellation

Paid plans are billed on a recurring monthly basis at the rate shown at checkout for your selected plan (currently Starter and Growth). Prices are subject to change with reasonable advance notice.

You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period, and we do not provide refunds or credits for partial billing periods except where required by law.

If a payment fails, we may suspend access to the Service until payment is resolved. Billing and plan changes are currently handled by our support team — contact us at support@myeveryday.io to change or cancel your plan.

6. Your Account & Data

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, including that of any team members you invite.

You retain all ownership rights to the data you enter into EveryDay, including your customers' information, jobs, estimates, invoices, and any files or photos you upload ("Customer Data"). We do not claim ownership over your Customer Data. You're solely responsible for having the right to collect and store any personal information about your own customers that you enter into the Service.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or the rights of any third party;
  • Upload or store unlawful, fraudulent, or harmful content;
  • Attempt to gain unauthorized access to the Service or other accounts;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Reverse engineer, resell, or white-label the Service without our written permission.

We may suspend or terminate accounts that violate this section.

8. Third-Party Services

EveryDay integrates with third-party services to provide certain features — for example, address autocomplete powered by Google Maps Platform, and (when enabled) online payment processing through a third-party payment processor. Your use of those features is also subject to the relevant third party's own terms.

9. Suspension & Termination

We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or if we reasonably believe your account poses a security or legal risk to EveryDay or other users. You may stop using the Service and close your account at any time by contacting support.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or fully secure.

11. Limitation of Liability

To the maximum extent permitted by law, EveryDay CRM will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months before the claim arose.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email or through the Service. Continued use of the Service after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the state in which EveryDay CRM operates, without regard to conflict-of-law principles. (Update this section with your actual business location and have it reviewed by an attorney.)
